No, it doesn't. A punishment has to be BOTH cruel AND unusual to fit that rule. Muslim law is prevalent enough to make this punishment "usual". Prisoners in the United States have been stricken down in hundreds of lawsuits, with the judge saying that, since the conditions they suffer are usual in prisons, the complaint does not fall under 8th amendment protection.
